Terms of Use

These Terms of Use ("Terms") govern your use of 442 Goals Game ("the game"), the website at 442goals.com, the web version at play.442goals.com, the iPhone app, the public API at api.442goals.com and any related features and services (together, "the Service"). The Service is operated by the team behind 442 Goals Game ("we", "us", "our"). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. Who can use the Service
The Service is a casual trivia game intended for a general audience. You must be old enough to agree to these Terms where you live, and at least 13. If you are under the age of majority in your country, review these Terms with a parent or guardian.
2. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial entertainment, in line with these Terms and, where you install through an app store, that store's rules. We may update, change or withdraw the Service or any feature of it at any time.
3. Our intellectual property
We own all rights in the Service that we created, including the software and source code, the game engine and scoring logic, our compilation and arrangement of data, original artwork and graphics, written content, and the specific look, layout and presentation of the game and website. Nothing in these Terms transfers any of those rights to you. You may not copy, adapt, decompile, reverse-engineer, scrape, extract, republish or create derivative works from any part of the Service, except to the limited extent the law expressly allows and cannot exclude.
We make no claim to exclusive rights in generic football terms, in formation names such as 4-4-2, in real club or player names, or in the general idea of a football trivia or squad-building game.
4. Acceptable use
You agree not to:
- use the Service for any unlawful, harmful, fraudulent or abusive purpose;
- cheat, automate, tamper with or falsify results, submissions or leaderboards, or interfere with the server-side replay and verification of games;
- attempt to gain unauthorised access to the Service, our servers or other players' data, or to disrupt, overload or interfere with the Service or its security, including by exceeding reasonable use of the public API;
- reverse-engineer, copy or build a competing product out of our code, content or data; or
- use the Service in any way that infringes the rights of, or restricts the enjoyment of, anyone else.
We may remove scores, names or player ids, or restrict access, if we reasonably believe these Terms have been broken, without notice where appropriate.
5. Display names
You choose a display name for the leaderboards. It is public. You are responsible for it and must not submit anything offensive, infringing, misleading, impersonating or otherwise unlawful. Names are filtered for offensive words, and we may change, reject or remove any name at any time at our discretion. By submitting a name you grant us a non-exclusive, royalty-free licence to display it as part of operating the Service. To report a name, email [email protected].
6. Leaderboards and fair play
There is one global leaderboard, and only your best score is kept on it. Submissions are replayed on the server, and a submission that does not replay to the claimed result is rejected. We may remove entries that we believe were produced by cheating, automation or multiple identities, and we may reset a board if the underlying data or rules change. Boards are provided for fun and carry no prize or monetary value.
7. Price
The Service is free of charge in its current version. If we introduce paid features in future, they will be described separately and processed by the relevant app store or payment provider under its own terms.
8. Third-party services and app stores
The Service is distributed and supported through third parties, including Apple and our hosting and analytics providers, each with their own terms and privacy policies. We are not responsible for third-party services, websites or content that we do not control.
9. Apple App Store
If you obtained the app from Apple's App Store, the following also applies: these Terms are between you and us only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. To the maximum extent permitted by law, Apple has no warranty obligation in respect of the app. Apple is not responsible for addressing any claims by you or any third party relating to the app, including product-liability, legal or regulatory, and consumer-protection claims, or any claim that the app infringes a third party's intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a relevant embargo and are not on any prohibited-parties list.
10. Unofficial and unaffiliated
442 Goals Game is an independent, unofficial, fan-made game. It is not affiliated with, endorsed by, sponsored by or connected to the Premier League or any other league or competition organiser, any football club, any player or players' association, the magazine FourFourTwo or its publisher, or Transfermarkt or any other statistics provider. Those names are used here only to state that no such relationship exists. Real club and player names appear in the game as plain text for identification only; no official names, logos, crests, kits, photographs or trademarks are used. Player statistics are compiled from publicly available sources and may contain errors or omissions. Nothing in the Service implies any endorsement or association.
11. No warranty
The Service is provided "as is" and "as available", for entertainment only. To the fullest extent permitted by law, we make no warranties or representations of any kind, express or implied, including as to availability, accuracy, reliability or fitness for a particular purpose, or that the Service will be uninterrupted, error-free or secure. Goal totals, ratings, tiers and achievements are for entertainment and are not a statement about real sporting performance. You use the Service at your own risk.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, goodwill or other intangible loss, arising out of or in connection with the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim (which for a free service is nothing) and ten pounds sterling. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including for death or personal injury caused by negligence, or for fraud.
13. Termination
You may stop using the Service at any time and can delete your server data from inside the game. We may suspend or end your access to the Service, or to online features, if you break these Terms or if we discontinue the Service. Sections 3, 10, 11, 12 and 15 survive termination.
14. Changes to these Terms
We may update these Terms from time to time. The date at the top of this page shows when they last changed. Continued use of the Service after a change means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where the law of the country you live in gives you the right to bring a claim locally, which these Terms do not take away.
